Caveat lenders are equity lenders. Defaults, court judgments, previous bankruptcies and even arrears on the existing mortgage do not usually stop a caveat loan, because the lender is secured by the property and expects to be repaid from a sale or refinance rather than from your monthly income. Some lenders do not check your credit file; those that do use it to understand the exit, not to decline you. Expect a slightly lower LVR and a higher rate where the credit history is poor.

What the lender assesses instead

Equity: how much value sits behind the existing mortgage. Title: whether it is clean and the lender can lodge a caveat. Exit: how and when they get repaid. Purpose: whether the loan is for business or investment, which keeps it outside consumer credit regulation. A borrower with a poor credit file but 50 per cent equity and a signed sale contract is a straightforward caveat loan. A borrower with a clean file, 10 per cent equity and no exit is not.

When bad credit still matters

If the credit file shows the borrower is being pursued by other creditors, the lender worries about competing caveats or a bankruptcy petition that could tie the property up. If the existing mortgage is in default and the bank has started enforcement, the caveat lender needs to know whether the loan will bring the mortgage up to date, because a bank sale would happen ahead of their caveat. In those cases the lender may require that the loan is used to fix the mortgage arrears first.

Using a caveat loan to repair credit

One legitimate use is to pay out a default or a tax debt quickly so it is listed as paid, then refinance to a specialist mortgage lender once the file has settled down. The caveat loan is the bridge, the specialist refinance is the exit, and the whole sequence needs to be planned before the caveat loan is taken, because the caveat lender's term is short and the refinance takes weeks.
